Please read these Terms and Conditions ("Terms") carefully. They govern your use of the website located at www.baycrawlspace.com (the "Site"), your communications with us by phone, text message, email, and chat, and the inspection, repair, installation, and maintenance services we provide (collectively, the "Services").
By using the Site, requesting an inspection, submitting a form, calling or texting us, or accepting a proposal from us, you agree to these Terms. If you do not agree, please do not use the Site or our Services.
These Terms are entered into between you and BAY Crawl Space & Foundation Repair ("BAY," "we," "us," or "our"), a Virginia contractor headquartered in Norfolk, Virginia.

1. Who May Use Our Services
You must be at least 18 years old and legally able to enter into a contract. You may request an inspection or services only for a property you own or are legally authorized to act on behalf of. If you are a tenant, a property manager, or an agent, you represent that you have the property owner's authority to request services and to authorize work.
We perform inspections at the request of the property owner or the owner's authorized representative. We do not perform buyer's or pre-purchase inspections on behalf of prospective purchasers.
2. Inspections, Proposals, and Pricing
Inspections. Inspections are scheduled appointments, typically lasting two to three hours. We recommend that all decision makers be present so that we can answer everyone's questions and design a complete scope of work in a single visit.
Inspection fees. Most owner-occupied residential inspections are provided at no charge. Inspections on rental properties, investment properties, and homes that are listed for sale or under contract are subject to an inspection fee, which is disclosed to you before the appointment is booked and is credited toward the cost of work if you proceed. Service and maintenance visits on previously installed BAY equipment are subject to a separate service visit fee.
Proposals. Any proposal, quote, or estimate we provide is based on the conditions observed and accessible at the time of inspection. Proposals are valid for the period stated on the document and are subject to change or withdrawal before acceptance. Pricing communicated verbally, by text, by email, or by our automated phone assistant is not binding; only a written proposal signed by you and accepted by BAY creates a contract for work.
Unforeseen conditions. Crawl spaces, basements, and foundations frequently conceal conditions that cannot be identified during a visual inspection, including but not limited to hidden structural damage, wood-destroying insect activity, buried debris, undisclosed utilities, plumbing or HVAC defects, hazardous materials, asbestos, lead, groundwater intrusion, and prior repairs. If we discover conditions that materially change the scope, cost, or feasibility of the work, we will notify you and provide a change order. Additional work is not performed and not billed without your authorization.
Not an engineering or code opinion. Our inspections and proposals are contractor evaluations, not engineering reports, code compliance certifications, structural certifications, real estate disclosures, or wood-destroying insect (WDI) reports, unless a specific document of that type is expressly ordered and provided in writing.
3. Scheduling and Access
Work is typically scheduled two to eight weeks after acceptance, depending on scope, crew availability, permitting, and weather. Some projects require multiple crews across multiple visits.
You agree to provide safe, clear, and unobstructed access to the work areas on scheduled dates, including access to crawl space entries, basements, exterior work zones, electrical panels, water, and power. You are responsible for securing pets, moving stored personal property out of work areas, and disclosing the location of any private utilities, septic systems, irrigation lines, invisible fencing, or other buried improvements.
If our crews arrive and cannot begin or continue work due to lack of access, unsafe conditions, standing water or sewage, active pest infestation, undisclosed hazardous materials, or conditions not disclosed to us, we may reschedule the work and assess a trip or remobilization charge as stated in your contract.
4. Payment, Deposits, and Financing
A deposit may be required at the time of acceptance. Deposits, progress payments, and final payment terms are stated in your signed contract and control over anything on this page.
Final payment is due upon substantial completion of the work unless your contract states otherwise. Past-due balances may accrue finance charges and collection costs, including reasonable attorney's fees, to the extent permitted by Virginia law.
Third-party financing may be available through unaffiliated lenders. Approval, rates, terms, and promotional offers are determined solely by the lender, not by BAY. We do not guarantee approval and are not responsible for a lender's decisions, disclosures, or servicing.
5. Warranties
Warranty coverage, duration, transferability, and exclusions are set out in the written warranty documents provided with your contract. Those documents are the complete and exclusive statement of the warranty we offer.
Except as expressly stated in a written warranty issued by BAY, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
Warranties do not cover damage caused by acts of nature, flooding, storm surge, plumbing or appliance leaks, HVAC failures, structural movement outside the repaired area, work performed or altered by others, neglect, failure to maintain equipment, failure to operate equipment as instructed, or conditions specifically excluded on your proposal.
Humidity and moisture performance targets, where stated, apply to the specific conditioned area described in your contract and assume the system is installed as designed, powered, maintained, and not modified.
6. Right to Cancel
If your contract was solicited or signed at your residence, you may have the right to cancel the transaction without penalty or obligation within three (3) business days, as provided by the Virginia Home Solicitation Sales Act and applicable federal law. Your specific cancellation rights and the required notice are provided with your contract documents.
Cancellations or postponements made after materials have been ordered, permits pulled, or crews mobilized may be subject to restocking, permitting, and mobilization charges as stated in your contract.
7. Consent to Be Contacted by Phone, Text Message, and Email
This section explains how and why we contact you and how you can stop it. Please read it before providing your phone number.

The subsections below describe this program in full.
7.1 Express Written Consent
By providing your phone number and opting in, you provide your express written consent to receive recurring automated calls and text messages (SMS/MMS) from BAY Crawl Space & Foundation Repair at the number provided, including through the use of an automatic telephone dialing system. Consent is given to BAY and to the authorized service providers that send messages on our behalf.
You provide your number and opt in when you submit a form on our Site, request an inspection, text us first, give your number to one of our representatives, or check a consent box.
7.2 Message Types
Message categories may include:
- Appointment messages: confirmations, reminders, reschedule notices, crew arrival windows, and requests to confirm your name, address, and email
- Customer care and job updates: questions about your project, permitting and scheduling updates, service and warranty follow-up, invoices, and payment reminders
- Sales follow-up: replies to inquiries, proposal follow-up, and answers to questions you have asked us
- Promotional and marketing messages (only if you have separately opted in to marketing messages): seasonal offers, promotions, maintenance reminders, and company news
7.3 Consent Is Not a Condition of Purchase
Consent to receive automated or marketing text messages is not a condition of purchasing any goods or services from BAY. You may request an inspection or purchase services without agreeing to receive marketing text messages.
7.4 Message Frequency
Message frequency varies based on your appointments, your project status, and your interaction with us. You can generally expect 2–8 messages per month. Appointment and job-related messages are sent as needed and may be more frequent while a project is actively underway.
7.5 Message and Data Rates
Message and data rates may apply. Your mobile carrier's standard messaging and data charges apply to all messages you send and receive. BAY is not responsible for these charges. Contact your wireless provider for details about your plan.
7.6 How to Opt Out (STOP)
You may cancel text messages at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a single message confirming that you have been unsubscribed, and you will receive no further text messages from that program unless you opt in again. You may also opt out by calling us at 757-460-0444 or emailing Appointments@baycrawlspace.com.
Opting out of text messages does not opt you out of phone calls, emails, or postal mail, and does not cancel your contract for services. If your project is active, we may still need to reach you by phone or email regarding scheduling, safety, or completion of the work.
7.7 How to Get Help (HELP)

7.8 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed. Message delivery is not supported on all carriers or devices.
7.9 No Sharing of Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories described in this section exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for marketing or promotional purposes.
Information may be shared with subcontractors and vendors that provide services on our behalf strictly to support the delivery of our own text messaging program — for example, our messaging platform, communications provider, and scheduling software — and those parties are contractually restricted from using it for any other purpose.
7.10 Telephone Calls, Autodialers, and Prerecorded Messages
By providing your telephone number to BAY, you agree that we and our authorized service providers may call and text you at that number for the purposes described above, including through the use of an automatic telephone dialing system, artificial or prerecorded voice, or artificial intelligence–assisted voice technology, even if the number is on a state or federal Do Not Call registry. Standard call and message rates may apply. You may revoke this consent at any time by any reasonable means, including by telling our representative, replying STOP to a text, calling us at 757-460-0444, or emailing Appointments@baycrawlspace.com.
7.11 AI-Assisted Communications
Some of our inbound and outbound calls, texts, and website chats are handled by an artificial intelligence virtual assistant that identifies itself as such at the start of the interaction. The AI assistant can answer questions, take messages, and schedule inspection appointments. It does not quote prices and does not create binding agreements. If you would prefer to speak with a live person, simply say so and we will connect you.
7.12 Call Monitoring and Recording
Calls to and from BAY may be monitored or recorded for quality assurance, training, scheduling accuracy, and record-keeping purposes. By continuing a call with us, you consent to that monitoring and recording. If you do not consent, please tell the representative or communicate with us in writing instead.
7.13 Email
By providing your email address, you agree to receive transactional emails related to your inspection, proposal, project, invoices, and warranty. If you opt in to marketing emails, you may unsubscribe at any time using the link in any marketing email. Unsubscribing from marketing emails does not stop transactional emails about an active project.
7.14 Privacy
Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Website Use
The Site is provided for informational purposes and to allow you to request services. You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms
- submit false, misleading, or fraudulent information, or another person's contact information without their permission
- attempt to gain unauthorized access to the Site, our systems, or any related systems
- scrape, harvest, or collect data from the Site by automated means without our written permission
- interfere with, disrupt, or overload the Site or its infrastructure
- upload malicious code or attempt to circumvent any security feature
We may suspend or terminate access to the Site at any time.
9. Intellectual Property
All content on the Site — including text, photographs, project galleries, graphics, logos, videos, layouts, and the BAY name and marks — is owned by BAY or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, modification, or commercial use requires our prior written permission.
If you submit a review, photograph, testimonial, or other content to us or about us, you grant BAY a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in our marketing.
10. Photographs of Your Property
Our crews routinely photograph and video conditions before, during, and after work for documentation, quality control, warranty, and training purposes. We may also use non-identifying project photographs in our marketing and on our website. We do not publish your name, street address, or other identifying details in marketing materials without your permission. If you prefer that your project photographs not be used in marketing, notify us in writing at Appointments@baycrawlspace.com and we will honor that request.
11. Third-Party Links and Services
The Site may link to third-party websites, financing providers, review platforms, and scheduling tools. We do not control and are not responsible for their content, products, privacy practices, or terms. Your dealings with third parties are solely between you and them.
12. Mold, Moisture, and Health Disclaimer
Mold treatment, moisture control, ventilation, and encapsulation services are intended to address conditions in the specific areas described in your contract. We are not medical professionals, industrial hygienists, or environmental consultants, and we do not diagnose, treat, or make representations about health effects. We do not perform clearance testing unless it is expressly included in your written scope of work. Nothing on the Site or in our communications constitutes medical, environmental, engineering, legal, or real estate advice.
13. Disclaimer of Warranties for the Site
The Site and all content on it are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that content — including pricing information, service descriptions, and service area maps — is accurate, complete, or current.
14. Limitation of Liability
To the fullest extent permitted by law, BAY and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost income, loss of use, diminution in property value, or business interruption, arising out of or relating to the Site, our communications, or our Services, whether based in contract, tort, warranty, or any other theory.
To the fullest extent permitted by law, our total liability arising out of or relating to the Site or our Services will not exceed the amount you actually paid to BAY for the specific services giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under Virginia law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence.
15. Indemnification
You agree to indemnify and hold harmless BAY and its owners, officers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your breach of these Terms, your misuse of the Site, your provision of another person's contact information without authorization, or your failure to disclose known hazardous conditions or the location of buried utilities and improvements at the property.
16. Dispute Resolution
Informal resolution first. If you have a concern, contact us at 757-460-0444 or Appointments@baycrawlspace.com before filing any claim. Most issues are resolved quickly and directly. You agree to give us at least thirty (30) days to resolve a dispute informally.
Binding arbitration. If we cannot resolve a dispute informally, you and BAY agree that any dispute arising out of or relating to these Terms, the Site, our communications, or our Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.
Class action and jury trial waiver. You and BAY each waive the right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Opt-out. You may opt out of this arbitration agreement by sending written notice to Appointments@baycrawlspace.com within thirty (30) days of first accepting these Terms. Opting out will not affect any other part of these Terms.
If your signed services contract contains its own dispute resolution provision, that provision controls for disputes about the work performed under it.
17. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. Subject to Section 16, any action that proceeds in court will be brought exclusively in the state or federal courts located in Norfolk, Virginia, and you consent to that jurisdiction and venue.
18. Service Area
We serve Coastal Virginia and northeastern North Carolina within approximately an 80-mile radius of Norfolk, Virginia. Service area boundaries are approximate and subject to change. We will confirm coverage for your address when you contact us.
19. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes take effect when posted. Your continued use of the Site or our Services after changes are posted constitutes acceptance of the revised Terms.
20. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and your signed contract and warranty documents, constitute the entire agreement between you and BAY regarding their subject matter. If there is a conflict between these Terms and your signed services contract, the signed contract controls with respect to the work performed under it.
